These Terms of Service ("Terms") govern your access to and use of Iris by BirdEye (the "App") provided by BirdEye ("we", "us", or "our"). By installing or using the App, you agree to be bound by these Terms.
1. Use of the App
Iris by BirdEye is a web accessibility widget designed for use on Shopify stores. You may use the App solely for lawful purposes and in accordance with these Terms. You agree not to:
- Use the App in any way that violates applicable laws or regulations
- Attempt to reverse engineer, decompile, or disassemble the App
- Use the App to infringe on any third party's intellectual property rights
- Resell or sublicense the App without our written consent
2. Subscriptions and Billing
Iris is offered on a subscription basis. By selecting a paid plan, you authorize us to charge your payment method on a recurring basis (monthly or annually, depending on your plan) through Shopify's billing system.
You may cancel your subscription at any time through your Shopify admin. Cancellation takes effect at the end of the current billing period. We do not offer refunds for partial billing periods.
3. Free Plan
We offer a free plan with limited functionality. We reserve the right to modify or discontinue the free plan at any time with reasonable notice.
4. License
Subject to these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable license to use the App on your Shopify store(s) as permitted by your subscription plan.
5. Accessibility Compliance Disclaimer
Iris by BirdEye is designed to assist with web accessibility but does not guarantee full compliance with WCAG 2.2, ADA, EAA, or any other accessibility standard. We strongly recommend conducting regular accessibility audits with qualified professionals. Use of the App does not constitute legal advice and does not guarantee protection from accessibility-related legal claims.
6. Intellectual Property
The App and all associated content, features, and functionality are owned by BirdEye and are protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or branding.
7. Termination
We may terminate or suspend your access to the App at any time, with or without cause, with or without notice. Upon termination, your right to use the App will immediately cease.
8. Limitation of Liability
To the maximum extent permitted by law, BirdEye shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App. Our total liability to you shall not exceed the amount you paid us in the three months preceding the claim.
9. Disclaimer of Warranties
The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the App will be error-free, uninterrupted, or free of harmful components.
10. Governing Law
These Terms shall be governed by the laws of the State of Delaware, without regard to its conflict of law provisions.
11. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page. Your continued use of the App after changes constitutes acceptance of the new Terms.
